LAWYERS are set to appeal a two-year jail sentence for a defendant found guilty of killing a thief who mugged a woman and made off with her bag in Fuengirola.
Defence lawyer Alfredo Herrera Rueda said the sentence sent the message that it was better to look the other way rather than attempt to stop crime.
The Ninth Criminal Court heard the defendant had left work when he saw the deceased and another making off with the woman’s bag at around 7.45am.
The woman was on her way to work when she was beaten and mugged.
Prosecutors told the court the defendant caught up with the mugger who collapsed after being punched twice.
He suffered a brain haemorrhage on impact and died two days later.
Herrara Rueda also criticised the court’s decision to order the defendant to pay €180,000 in damages to the deceased’s daughters.
