TWO Hospital del Poniente gynaecologists were found guilty of negligence following the death of woman and her unborn child.
An Ejido court cleared a third gynaecologist who examined the 46-year-old mother and requested a caesarean. Despite her age and a previous miscarriage, this was refused, the court heard.
The judge observed responsibility in the two other doctors for the mother’s death after they finally decided on an emergency caesarean, but cleared them of the baby’s death as it had not been possible to determine the causes, she said. The judge added that she shared the pathologist’s opinion that “more determined and less conservative action in a labour that had hardly progressed in 12 hours would have given a different outcome.”
Hospital de Poniente must now pay €105,133 compensation to the woman’s husband and €95,575 to be shared between the dead baby’s stepbrothers.
