A MALAGA Provincial court has jailed a man in his 70s for five years for killing his adult son with a hammer in January 2014.
Although the father admitted in court that he had killed his son by beating him over the head with a hammer while the two were alone, he explained that it was not planned and all happened in a moment of rage which he was unable to control.
The victim’s drug addiction had caused many problems within the family, to the point that the father had not long beforehand had to report his son to the police, and a judge had given the 40-year-old son 25 days house arrest as punishment.
In fact it was when local policemen arrived at the family home at 5pm that the father broke down and told them that he had killed his son, carried him into his bedroom, cleaned up and gone out for a while before returning home to watch television with the rest of the family.
Although the defence pleaded for the man to be absolved claiming the pressure he had been under had been too much, a jury found him guilty of manslaughter.
