Marina residents seek legal solution to noise

SOME 30 residents in Puerto Marina have taken the first steps to take Benalmadena Town Hall to court for not enforcing noise controls. In July 2008, the Andalucian Supreme Court of Justice ruled that Velez-Malaga town hall should pay each of the 18 plaintiffs who took them to court over noise levels €156,000 in compensation.

This was the first sentence in Malaga province against a town hall for not solving residents’ problems due to excessive noise, and the highest amount of compensation awarded for this reason in Spain.

Now, Puerto Marina residents are looking for a similar result and have presented the town hall with an administrative complaint, the first step before taking legal action against the public administrations.

In the complaint, the ask the town hall to solve the problem, and have included a file with the complaints they have made over the years, medical reports, letters to the Andalucian Ombudsman, noise level reports and other documents.

Benalmadena Town Hall has two months to respond. If they do not, the group can bring a case against the council.
