A JURY has found a man guilty of homicide by negligence for the death of his girlfriend at their Albox home in March 2018.
In the trial at the Almeria Provincial Court, the jury also concluded that M.P. was guilty of gender-based violence.
According to reports, M.P. punched his partner in the face in the apartment bathroom which caused her to smash the back of her head against a cabinet. Hence it was believed he had not acted with the intention of killing her. However, it was also found that the incident was the last in a series of habitual abusive behaviour towards the victim.
In the verdict the jury reportedly recognised the seriousness of the blows meted out to the girlfriend, and that at the time she had not been in the best state of health due to poor diet and a chronic alcohol addiction. Also recognised was the failure of the defendant to alert the emergency services until between six and eight hours after the incident.
The victim was found to have died as a consequence of a head injury, aggravated by her poor health. The jury also conclude that that injury may not have proved fatal if the emergency services had been called out earlier.
In fact, the jury determined that by the time the defendant did make the call the woman had already died, and that he moved her from the bedroom to the sitting room, where he covered her with a blanket.
