THE Trial against David Serrano, the owner of the well that claimed the life of 2 year old Julen, has been set for January 21 2020.
The trial comes just days after the anniversary of the tragic events in the Axarquian town of Totalan which captured the world’s hearts.
The owner of the farm, David Serrano will sit before the judge facing three years in prison for the crime of reckless homicide through negligence.
Already facing mammoth fines which have led Serrano to declare voluntary bankruptcy, the family of Julen are pushing for the sentence to be extended by six months as they say that the circumstances surrounding the accident show “extreme negligence”.
The defence team of Serrano are asking for the sentence to be acquitted as they suggest that David warned the family on numerous occasions of the presence of the well and that he did not realise that the well was wide enough to fall into.
The prosecution team argues that, “Serrano was the only one who knew about the presence of the well and knowing all this and the lack of sufficient and adequate protection, he did not take any action to avoid any possible harmful outcome, endangering the lives of the two minors”.
