‘KIDNAP’ TRIAL: Verdict due for Brit defendants after disappearance of woman from Marbella nightclub

MALAGA’S Provincial Court is weighing its verdict on two British defendants on trial over the disappearance of a Latvian woman from a Marbella nightclub.

Prosecutors told the court’s Second Section Westley Capper, 41, and Craig Porter, 37, forced a ‘fearful’ Angese Klavina into Capper’s Mercedes S63 outside the Puerto Banus nightclub in September 2014. The pair face up to 12 years in prison each if found guilty.

State Prosecutor Maria del Carmen Tirado said in her closing statement on Monday that Klavina, aged 30 when she disappeared, was ‘coerced’ into going with the defendants.

Tirado told the court earlier in the trial the pair had kidnapped Klavina and later dumped her body in the Mediterranean from Capper’s boat.

“The images show that when she left that nightclub she didn’t want to go with Capper and she didn’t want to get into the car,” Tirado said.

Private prosecutors said CCTV footage showing Klavina getting into the car was a ‘filmed crime’.

Nightclub bouncer Siene Ousmane is also standing trial. Prosecutors claimed he held the car door closed to stop her getting out.

Capper and Porter both deny any wrongdoing. They claim Klavina wanted to go with them and that she was drunk and needed help getting into Capper’s car.

Capper’s defence lawyer Jorge Hoz told the court the prosecution’s claims were ‘conjecture and speculation’.

“The only evidence that is undisputed is that Agnese Klavina left the nightclub and got into a car driven by my client,” Hoz said.

DNA evidence was never found in Capper’s car or on his boat, the court heart. The court is due to deliver its verdict in the coming weeks.
