A SPANISH judge has placed all five men who were in the apartment with Kirsty Maxwell when she died, under formal investigation.
Judge Ana Isabel Garcia-Galbis has also asked if the dubbed ‘Benidorm Five’ have any previous records and has said she wants to quiz the men on July 26.
Luis Miguel Zumaquero, the lawyer acting on behalf of Ms Maxwell’s family, fought for the decision as well as a court quiz of the receptionist at the apartment block.
The judge however refused to quiz all five in the same room as there seems to be “no irregularities in their statements.”
Mr Zumaquero said following the decision that “the authorities here would be in a stronger position to make all five men return to Spain if they were placed under investigation and were not treated as mere witnesses.
“But it doesn’t mean that we have achieved our objective. There’s a long road ahead but we’ve taken an important first step.”
Joseph Graham, 32, was originally the only man facing a court probe following her death while she celebrated a hen do.
