Can he fight insurance company?

I was involved in a traffic accident that was not my fault. I had insurance through a broker. My broker, however, failed to pass on full information to the insurance company. The insurance company wrote off my car and because the brokers failed to pass on the relevant information, I will receive nothing for my car. I am on a disability pension and cannot afford to lose my car.

Fighting the insurance company is never easy but it sounds as if you have a case. The first step is to discuss the problem with your broker. If you find him reluctant to help, you can contact the ‘Atención al Cliente’ or ‘Defensor del Asegurado’ department of the insurance company. There is a telephone number on your policy. You will need to put your case in writing.

Every company has such an office. If all else fails, you complain to the DGS, the ‘Direccion General de Seguros,’ at Paseo de la Castellana, 44, Madrid 28046, in writing. You can also call them on the telephone at 902 191 111.
