BARS and restaurants in Benalmadena’s Puerto Marina which fail to meet noise regulations have started to take their terraces down following a recent sentence by the Andalucian High Court.

The councillor for the marina, Encarnacion Cortes, confirmed last week that the council had started to close down terraces and that bar and restaurant owners would have to make necessary adjustments before they could reopen.

Local residents had been complaining about the noise in the marina since 1998 and had contacted the council a number of times but were forced to take the matter to court as nothing was done to improve matters. Although initially a Malaga court found in favour of the council, the residents appealed and finally the high court awarded them damages and insisted the situation be remedied.
