THE Supreme Court plans a definitive ruling on the Algarrobico issue in September.
Acting head of the Junta’s Environment Department Maria Jesus Serrano welcomed the prospect of a solution to what the Supreme Court termed “legal chaos.”
The hotel, built too near the water’s edge in the Cabo de Gata National Park, infringes planning and coastal regulation and is due to be demolished on the Junta’s orders.
The Supreme Court will rule on conflicting verdicts from Andalucia’s Upper Court of Justice (TSJA) regarding Azata del Sol’s planning permission, the legality of the company’s building permit and the Junta’s right to step in and acquire the property.
