LUIS and Ricardo de Frutos, alleged victims of homophobic aggression, will appear before an Almeria judge later this month.
The father of a 25-year-old accused of attacking them has also been called to declare.
The married couple claim that the incident, which coincided with International LGTB Day last year, occurred as they were about to swim in the nude at Almeria City’s Torregarcia beach.
They in turn could be charged with exhibitionism and causing bodily harm arising from an official complaint lodged by the younger man.
According to Luis (aged 54) and Ricardo (68), the 25-year-old and his father pounced on them, shouting “Don’t go any further, poofs!” After a heated argument, the son began attacking them, egged on by the older man.
Witnesses who called police agreed that the married men were kicked and punched by their adversaries. Luis’s eyebrow later needed four stitches and Ricardo, whose ribs were covered in bruises and grazes, lost consciousness.
“The attack was clearly of a homophobic and discriminatory nature,” said the couple’s defence lawyers, who are contesting the charges levelled against their clients.
