A PRISON guard who ‘lewdly fondled’ an inmate has been jailed for two years after being found guilty of sexual assault.
The El Acebuche prison guard and head of department was sentenced after Almeria Criminal Court heard he had molested two inmates.
The sentence stated that, in July 2008, the guard, known as JALC, ordered an unjustified strip search on several male inmates, “lewdly” fondling one of them, known as VIM. The victim tolerated it thinking it was “the ordinary way of carrying out the frisks.”
It also stated that, in the early hours of March 1 last year, JALC “silently” entered a cell in the prison’s medical unit where he fondled MAP, who was clothed at the time.
For the second offence, JALC alleged that he entered MAP’s cell because he had heard noises, which made him believe that an escape attempt might be taking place. The judge did not believe his version because JALC did not inform the warden or make a written report about a possible escape attempt, as well as because of how cautiously he entered MAP’s cell.
The court accepted the prosecutor’s request of two years in prison, a €7,200 fine and compensation of €1,500 for VIM and €700 for MAP.
