MALAGA Provincial Court has shelved the case against the mayor of Nerja for allegedly granting a building licence to the girlfriend of a local councillor in 2003.
The court has ruled that the mayor, Jose Alberto Armijo, made his decision based on reports from the municipal architect, an engineer and a lawyer, against whom the case will continue.
The reports recommended that the license be granted and the court has decided there is no proof that Armijo knew his decision was illegal.
The first owner of the plot was promised a license if he carried out a series of requirements, but in 1997, he decided not to.
In 2005, finding himself unable to obtain the license, he sold it to a councillor in the opposition in Nerja, whose partner requested the license.
The lawyer against whom the case will continue has admitted that he contradicted himself in the reports issued regarding the viability of granting a license.
Once it belonged to the councillor, he no longer claimed it was in a ‘green area’.
