A COURT has refused Velez-Malaga Town Hall permission to enter a property and dismantle an illegally installed mobile phone mast.
The mast was installed without a licence 16 years ago next to the Torre Moya watchtower on the Cortijada Los Perez property in Benajarafe and the town hall, attending to complaints from the 350 local residents who linked it to 50 cases of cancer, had requested permission to take it down according to the New Technologies Councillor, Concha Labao.
This is the second time the request has been denied, although the councillor said the town hall intends to appeal the ruling as well as making contact with Vodafone, the owner of the mast.
The town hall ordered that it be demolished in 2009, and the company partially dismantled it but appealed the demolition order in court.
However, Vodafone promised to take it down by March. Despite the claims of locals, it has been confirmed that the level of emissions are within those allowed by law.
